These Terms and Conditions (“Terms”) govern your access to and use of BenAdvice, including the website, account system, dashboard, paid passes, credits, advice cases, responses, admin tools, and related services.

By accessing BenAdvice, creating an account, purchasing a pass, submitting a case, or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use BenAdvice.

1. What BenAdvice Is

BenAdvice is an entertainment and personal-opinion service where users can submit questions, situations, ideas, or “cases” to Ben for a human-written response.

BenAdvice is intended to be funny, personal, and sometimes helpful. It is not a professional service.

2. What BenAdvice Is Not

BenAdvice is not a substitute for licensed professionals. Ben is not acting as your lawyer, doctor, therapist, financial advisor, emergency responder, fiduciary, agent, or licensed professional.

If you are experiencing an emergency, crisis, danger, or risk of harm to yourself or others, contact emergency services or a qualified professional immediately.

3. Entertainment and Personal Opinion Only

All responses from BenAdvice are for entertainment, personal opinion, and general informational purposes only.

You are solely responsible for your decisions, actions, consequences, and reliance on any response.

BenAdvice is not responsible for what happens before, during, or after you use the Service, including any decisions you make based on a response.

4. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to purchase or use BenAdvice.

  • Your use of the Service does not violate any law or agreement that applies to you.
  • Any information you provide is accurate and current.

5. Accounts

To purchase credits or submit cases, you may need to create an account.

  • Provide accurate account information.
  • Keep your login credentials secure.
  • Do not share, sell, or transfer your account.
  • Be responsible for all activity under your account.
  • Notify us if you suspect unauthorized access.

6. Ben Pass — $23

The Ben Pass is a one-time paid credit package. Unless otherwise stated at checkout, the Ben Pass costs $23.

  • Includes 23 normal Ben Credits.
  • Allows up to 3 paid normal case submissions per month, subject to account limits and availability.
  • May include up to 5 compressed image attachments per request where supported.
  • Includes up to 1 follow-up per answered normal case, unless otherwise stated at checkout.
  • Credits do not expire while the Service remains available and your account remains active.
  • No subscription.
  • No AI-generated response, unless clearly disclosed otherwise.
  • Final sale / non-refundable purchase, except where required by law.

7. Deep Ben Pass — $114

The Deep Ben Pass is a higher-tier one-time paid credit package. Unless otherwise stated at checkout, the Deep Ben Pass costs $114.

  • Includes 23 Deep Ben Credits.
  • Allows up to 3 paid Deep Ben case submissions per month, subject to account limits and availability.
  • May include up to 5 compressed image attachments per request where supported.
  • Designed for longer questions, up to 15,000 characters where supported, and a longer, more detailed response.
  • Receives priority queue treatment where available.
  • Includes up to 5 follow-ups per answered Deep Ben case, unless otherwise stated at checkout.
  • Limited beta availability.
  • No subscription.
  • No AI-generated response, unless clearly disclosed otherwise.
  • Final sale / non-refundable purchase, except where required by law.

8. Credits

Credits are a limited digital access right within BenAdvice.

Credits remain available while your account is active and the Service remains available, subject to these Terms.

  • Have no cash value.
  • Are not legal tender.
  • Are not stored value.
  • Are not gift cards.
  • Are not transferable.
  • May not be sold, traded, or exchanged.
  • May only be used within BenAdvice.
  • Are consumed only when Ben sends a response.
  • Are not consumed by pending, rejected, skipped, or unanswered cases.

9. When Credits Are Used

A credit is only used when BenAdvice sends a response to your case.

If a case is answered, the applicable credit is consumed.

  • Pending cases do not consume credits.
  • Rejected cases do not consume credits.
  • Skipped cases do not consume credits.
  • Unanswered cases do not consume credits.
  • Cases removed for technical or moderation reasons before an answer is sent do not consume credits.

10. Response Times Are Not Guaranteed

BenAdvice does not guarantee response times. Responses may take hours, days, weeks, or longer.

Some cases may never receive a response if they are rejected, unsafe, spammy, abusive, too serious, outside the scope of the Service, or otherwise not appropriate for BenAdvice.

If Ben does not answer a case, the credit is not consumed.

11. Final Sale and Refund Policy

All purchases are final and non-refundable, except where required by law or expressly stated by us in writing.

We may, in our sole discretion, review duplicate purchases, payment errors, suspected fraud, or unusual circumstances, but we are not required to issue refunds unless required by law.

  • You are buying credits for use within BenAdvice.
  • Credits are only used when Ben answers.
  • Pending, rejected, skipped, or unanswered cases do not consume credits.
  • Credits remain available in your account while the Service is available and your account remains active.
  • Purchases are final.
  • Refunds are not guaranteed.
  • Chargebacks or payment disputes may result in account suspension or termination.

12. Payment Processing

Payments may be processed by third-party payment providers such as Stripe.

You agree to provide accurate billing information and comply with the payment processor’s terms.

We do not store your full card number or card security code.

If a payment is reversed, disputed, refunded, charged back, or suspected to be fraudulent, we may remove credits, suspend your account, close cases, or terminate access.

13. Taxes

Prices may not include applicable taxes unless stated otherwise.

You are responsible for any taxes, duties, fees, or charges that apply to your purchase, except where we are required to collect and remit them.

14. Case Submission Rules

You may submit cases according to the features and limits available in your account.

  • Do not request legal, medical, financial, therapeutic, crisis, or professional advice.
  • Do not submit emergencies or immediate danger situations.
  • Do not encourage harm to yourself or others.
  • Do not encourage illegal activity.
  • Do not include threats, harassment, abuse, or hate.
  • Do not submit spam or repeated low-quality submissions.
  • Do not include private information about others without permission.
  • Do not attempt to bypass usage limits, payment systems, or moderation.
  • Do not require credentials Ben does not have.

15. Ben’s Responses

Ben’s responses are personal opinions and entertainment. We do not guarantee that any response will be accurate, useful, appropriate, safe, satisfying, or suitable for your situation.

16. No Reliance

You agree not to rely on BenAdvice as the sole basis for any serious decision. If your situation matters, contact a qualified professional or trusted person in real life.

17. User Content

“User Content” means anything you submit, upload, write, send, or otherwise provide through BenAdvice.

You are responsible for your User Content. You represent that you have the right to submit your User Content and that it does not violate these Terms, the law, or anyone else’s rights.

18. License You Grant to BenAdvice

By submitting User Content, you grant BenAdvice a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, and use your User Content as necessary to provide and operate the Service.

This license does not allow us to publicly use private cases for marketing or content unless you give permission, except where necessary for legal, safety, enforcement, or dispute-resolution purposes.

19. Permission to Use Cases in Content

When submitting a case, you may choose whether BenAdvice can use it in public content.

If you select a permission option that allows public use, you grant BenAdvice permission to edit, anonymize, modify, publish, display, distribute, create derivative works from, and use the permitted case and response.

If you choose “No, keep private,” we will not intentionally use the case in public content or marketing, except where required for legal, safety, enforcement, or dispute-resolution purposes.

20. Acceptable Use

You agree not to misuse BenAdvice.

  • Do not use BenAdvice for unlawful purposes.
  • Do not abuse, threaten, harass, or harm others.
  • Do not submit illegal, harmful, exploitative, or abusive content.
  • Do not spam the Service.
  • Do not create fake accounts to bypass limits.
  • Do not share, sell, or transfer your account.
  • Do not scrape, copy, reverse engineer, or attack the Service.
  • Do not attempt to access admin systems.
  • Do not upload malware or malicious code.
  • Do not circumvent payment systems or credits.
  • Do not use bots or automation.
  • Do not misrepresent BenAdvice responses as professional advice.

21. Account Suspension or Termination

We may suspend, restrict, delete, or terminate your account at any time, with or without notice, to the maximum extent permitted by law.

If your account is terminated for violating these Terms, you may lose access to cases, responses, and credits, and you may not be entitled to a refund.

22. Service Changes and Discontinuation

We may update, modify, suspend, limit, or discontinue BenAdvice at any time. We are not liable for changes, suspensions, or discontinuation of the Service, except where required by law.

23. Beta and Experimental Nature

BenAdvice may be experimental, especially during launch. You use BenAdvice at your own risk.

  • The Service may change frequently.
  • The Service may contain errors.
  • The Service may be unavailable.
  • Responses may be delayed.
  • Features may be incomplete.
  • The Service may be discontinued.
  • The Service may not meet your expectations.

24. Third-Party Services

BenAdvice may rely on third-party services, including payment processors, hosting providers, authentication providers, database providers, email providers, analytics providers, and security tools.

We are not responsible for third-party services, outages, policies, acts, omissions, data practices, or failures, except where required by law.

25. Intellectual Property

BenAdvice owns or licenses all rights in the Service, excluding your User Content. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from BenAdvice except as allowed by these Terms or applicable law.

26. Feedback

If you send us feedback, ideas, suggestions, bug reports, feature requests, or improvements, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, publish, and incorporate that feedback without compensation or obligation to you.

27. Privacy

Your use of BenAdvice is also governed by our Privacy Policy.

28. Disclaimer of Warranties

To the maximum extent permitted by law, BenAdvice is provided “as is” and “as available.”

We do not warrant that the Service will be uninterrupted, Ben will respond within any particular time, responses will be accurate or helpful, data will never be lost, third-party services will always work, or any outcome will result from using BenAdvice.

29. Limitation of Liability

To the maximum extent permitted by law, BenAdvice, Ben, its owners, developers, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, emotional, personal, financial, legal, health, or reliance-based damages.

To the maximum extent permitted by law, our total liability for any claim relating to BenAdvice or these Terms will not exceed the greater of: (A) the amount you paid to BenAdvice in the 12 months before the claim arose; or (B) USD $23.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

30. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BenAdvice, Ben, its owners, developers, contractors, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from or related to your use of BenAdvice.

31. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.

32. Disputes

Before filing a claim, you agree to first contact us at thebenadvice@gmail.com. We will try to resolve the issue informally.

If a dispute cannot be resolved informally, you agree that any legal action will be brought in the state or federal courts located in Pennsylvania, unless applicable law requires otherwise.

You and BenAdvice agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, consolidated, or representative action, to the extent permitted by law.

33. Changes to These Terms

We may update these Terms from time to time. Your continued use of BenAdvice after updated Terms become effective means you accept the updated Terms.
